Every year, there are thousands of “shakedown” lawsuits against California small business owners alleging violations of the Americans with Disabilities Act (ADA).
Many of these “drive-by” cases result in an attorney being paid a settlement fee of thousands of dollars to simply make the case go away, without any changes to improve disabled access. These lawsuits hurt small businesses, hinder job growth and endanger our economic recovery.
The California Legislature is currently considering bills (AB 52, AB 54, SB 67, and SB 251) to curb “shakedown” lawsuits while increasing access for the disabled.
